TERMS OF USE

Welcome to Local Farmstand Finds.


These Terms of Use (“Terms”) govern your access to and use of the Local Farmstand Finds website, interactive maps, directories, listings, databases, content, features, services, communications, and other online or digital resources (collectively, the “Services”).


Local Farmstand Finds is operated by American Farmstand Association LLC (“AFA,” “Local Farmstand Finds,” “we,” “us,” or “our”).


By accessing, browsing, searching, submitting information to, creating an account on, purchasing through, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.


If you do not agree to these Terms, you may not use the Services.


1. Purpose of Local Farmstand Finds

Local Farmstand Finds provides resources intended to help consumers discover farmstands, farms, cottage food businesses, roadside stands, honor-system stands, growers, bakers, makers, agricultural destinations, and other locally operated businesses and experiences.

The Services may include directories, maps, farmstand listings, trails, farmstand crawls, events, articles, photographs, business information, user-submitted information, recommendations, educational materials, membership features, and related resources.

Local Farmstand Finds is primarily an informational and discovery platform. Unless expressly stated otherwise, we do not own, operate, manage, supervise, inspect, certify, license, or control businesses listed through the Services.


2. Eligibility and Acceptance

You must be legally capable of entering into a binding agreement to use the Services.

If you use the Services on behalf of a business, organization, farm, association, government entity, or other entity, you represent that you have authority to bind that entity to these Terms.


3. Limited License to Use the Services

Subject to these Terms, Local Farmstand Finds grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services for lawful personal purposes.


This license does not transfer ownership of any portion of the Services or grant permission to commercially exploit Local Farmstand Finds content, data, maps, directories, or other intellectual property.


Any rights not expressly granted are reserved by Local Farmstand Finds and American Farmstand Association LLC.


4. Ownership of the Website, Directory, Maps, and Content

The Services and their contents are owned by, licensed to, or used with permission by Local Farmstand Finds and/or American Farmstand Association LLC.

Protected materials may include, without limitation:

  • website design and layout;
  • Local Farmstand Finds maps;
  • farmstand directories and databases;
  • selection, compilation, organization, coordination, categorization, and presentation of farmstand information;
  • original descriptions and written content;
  • photographs, illustrations, graphics, icons, and videos;
  • logos, names, branding, slogans, and trade dress;
  • farmstand trails and crawl materials;
  • event materials;
  • downloadable resources;
  • research and collected information;
  • database structures and taxonomy;
  • membership materials;
  • software and functionality; and
  • other original content appearing through the Services.


These materials may be protected by copyright, trademark, contract, unfair competition, database-related rights, and other applicable laws.


The fact that individual facts, business names, addresses, or other information may be publicly available does not grant permission to copy, extract, reproduce, republish, or commercially exploit Local Farmstand Finds' compilation, database, organization, presentation, or collection of such information.


5. STRICT PROHIBITION ON SCRAPING, DATA HARVESTING, AND AUTOMATED ACCESS

Local Farmstand Finds has invested substantial time, labor, resources, relationships, research, verification efforts, organization, and expense into developing and maintaining its directory, maps, listings, and related data.


You may not scrape, crawl, spider, harvest, extract, download, copy, index, collect, monitor, reproduce, aggregate, or otherwise acquire data or content from the Services through automated, programmatic, systematic, or bulk means without our prior express written authorization.

Prohibited methods include, without limitation:

  • web scrapers;
  • crawlers;
  • spiders;
  • bots;
  • robots;
  • scripts;
  • browser automation;
  • browser extensions designed for extraction;
  • APIs not expressly authorized by us;
  • automated queries;
  • headless browsers;
  • data-mining software;
  • screen-scraping technology;
  • artificial intelligence agents;
  • machine-learning systems;
  • automated extraction tools; and
  • any similar technology or process.


You also may not manually collect information from the Services in a systematic or bulk manner for the purpose of creating, maintaining, enriching, supplementing, verifying, or operating a database, directory, map, application, website, service, mailing list, lead list, marketing platform, or commercial product.


6. PROHIBITED USE OF LOCAL FARMSTAND FINDS DATA

Without prior express written authorization from Local Farmstand Finds, you may not use information obtained from the Services to:

  1. create or populate another farmstand directory, database, map, application, platform, website, or service;
  2. develop or operate a product or service that competes with Local Farmstand Finds or American Farmstand Association;
  3. reproduce or republish all or any substantial portion of the Local Farmstand Finds directory;
  4. sell, license, sublicense, rent, distribute, transfer, or commercially exploit Local Farmstand Finds data;
  5. create marketing, sales, solicitation, prospecting, or lead-generation lists;
  6. send unsolicited commercial communications to businesses appearing on the Services;
  7. aggregate Local Farmstand Finds listings with information from other sources for commercial purposes;
  8. create derivative databases or datasets;
  9. train, fine-tune, test, benchmark, evaluate, ground, retrieve information for, or otherwise develop an artificial intelligence, machine-learning, large language model, generative AI, or similar computational system;
  10. provide Local Farmstand Finds content or data to an AI system for inclusion in a dataset, knowledge base, vector database, retrieval system, model, or similar repository;
  11. use Local Farmstand Finds data to identify, target, profile, solicit, or commercially contact farmstand owners or operators;
  12. bypass restrictions intended to prevent automated collection or access;
  13. disguise, rotate, proxy, or otherwise obscure IP addresses, device identifiers, accounts, or access patterns for the purpose of avoiding access restrictions;
  14. circumvent CAPTCHAs, rate limits, authentication systems, robots directives, technical safeguards, or other access controls; or
  15. assist, enable, encourage, or provide tools to another person or entity to perform any prohibited activity.


Access to publicly viewable portions of the Services does not constitute authorization to scrape, harvest, copy, reproduce, republish, or commercially exploit the data contained therein.


7. Machine Learning, Artificial Intelligence, and Generative AI

Unless Local Farmstand Finds provides express written permission, content and data from the Services may not be used for artificial intelligence or machine-learning purposes.

This prohibition applies regardless of whether the resulting system is commercial, nonprofit, internal, experimental, publicly available, or privately operated.

It includes ingestion into training datasets, retrieval-augmented generation systems, vector databases, embeddings databases, knowledge graphs, model evaluation datasets, or similar systems.


Nothing in these Terms grants any text-and-data-mining, machine-learning, or artificial-intelligence training rights.


8. Technical Enforcement and Access Restrictions

Local Farmstand Finds reserves the right to monitor use of the Services and employ technical measures to detect, prevent, limit, or block activity that we reasonably believe violates these Terms or threatens the security, integrity, availability, performance, value, or operation of the Services.


Such measures may include rate limiting, bot detection, CAPTCHA challenges, access restrictions, IP blocking, account suspension, request filtering, and other technical measures.

You may not attempt to circumvent such measures.


We may suspend, restrict, or terminate access to the Services at any time, with or without prior notice, where permitted by law.


9. Unauthorized Use and Enforcement

Unauthorized scraping, extraction, copying, redistribution, republication, or commercial exploitation of Local Farmstand Finds content or data may cause substantial harm that may be difficult to quantify.


Local Farmstand Finds and American Farmstand Association LLC reserve all rights and remedies available under contract, copyright, trademark, unfair competition, computer access, trespass, misappropriation, and other applicable federal and state laws.


Where appropriate, we may seek injunctive relief, monetary damages, recovery of profits, costs, attorneys' fees where recoverable, and any other remedies available by law or equity.


Our failure to immediately enforce any provision of these Terms does not waive our right to enforce that provision later.


10. Search Engines

Notwithstanding the automated-access restrictions above, Local Farmstand Finds may permit established general-purpose public search engines to crawl portions of the Services solely for the purpose of creating publicly searchable indexes that link users back to Local Farmstand Finds.


This exception does not authorize the creation of caches, datasets, directories, commercial databases, AI training datasets, competing services, or standalone reproductions of Local Farmstand Finds content.


Local Farmstand Finds may revoke or limit this permission at any time.


11. Farmstand and Business Listings

Information appearing in a Local Farmstand Finds listing may come from business owners, operators, publicly available sources, community members, Local Farmstand Finds research, or other sources.

We attempt to provide useful information, but we do not guarantee that listings are complete, accurate, current, or error-free.

Business information can change at any time, including:

  • operating hours;
  • seasonal availability;
  • products;
  • pricing;
  • payment methods;
  • addresses;
  • contact information;
  • inventory;
  • ownership;
  • event participation;
  • licensing or permitting status; and
  • whether a farmstand is currently operating.


Users should independently verify important information before traveling to or purchasing from a listed business.


12. No Endorsement, Certification, or Guarantee

Inclusion on Local Farmstand Finds does not constitute an endorsement, certification, inspection, guarantee, or recommendation by Local Farmstand Finds or American Farmstand Association LLC unless expressly stated otherwise.


Likewise, paid membership, sponsorship, advertising, enhanced listings, participation in a farmstand trail or crawl, or other commercial relationships do not constitute a guarantee regarding a business's products, safety, legality, practices, or quality.


13. Food, Agricultural, and Product Disclaimer

Local Farmstand Finds does not manufacture, prepare, package, inspect, distribute, or sell products offered by independently operated businesses appearing on the Services unless expressly stated otherwise.


Each farmstand, producer, baker, farmer, maker, vendor, or other business is independently responsible for its own:

  • food safety;
  • ingredients;
  • allergen disclosures;
  • labeling;
  • product quality;
  • pricing;
  • licensing;
  • permits;
  • taxes;
  • insurance;
  • agricultural practices;
  • cottage food compliance;
  • business operations; and
  • compliance with applicable laws.


Local Farmstand Finds is not responsible for illness, allergic reactions, injuries, losses, damages, product defects, contamination, labeling errors, or other consequences arising from products or services obtained from a listed business.


Individuals with allergies, dietary restrictions, medical conditions, or other concerns should communicate directly with the applicable business before purchasing or consuming products.


14. Travel and Property Risks

Visiting farms, farmstands, roadside stands, rural properties, and agricultural locations may involve inherent risks.


Potential conditions may include animals, farm equipment, uneven terrain, gravel roads, weather, insects, plants, fences, bodies of water, limited lighting, vehicle traffic, and other hazards.


Users are responsible for evaluating conditions and exercising reasonable care when visiting any location discovered through Local Farmstand Finds.


Local Farmstand Finds does not control the premises of independently operated businesses and is not responsible for injuries, accidents, property damage, theft, or other incidents occurring at those locations.


15. Farmstand Crawls, Trails, and Events

Local Farmstand Finds may organize, promote, coordinate, sponsor, or provide information regarding farmstand crawls, farmstand trails, tours, and other events.

Unless expressly stated otherwise, participating locations remain independently owned and operated.


Event routes, participants, schedules, offerings, samples, products, availability, and operating conditions may change without notice.


Participation in an event or use of an event route is voluntary and at the participant's own risk.

Users remain responsible for their transportation, personal safety, purchases, and interactions with participating businesses.


16. User Submissions

Users, farmstand owners, members, businesses, and other parties may submit information, photographs, descriptions, corrections, logos, links, addresses, or other materials (“User Content”).


You retain ownership of rights you hold in your User Content.


By submitting User Content, you grant Local Farmstand Finds and American Farmstand Association LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify for formatting, display, distribute, publish, and use that content for operating, promoting, marketing, and improving Local Farmstand Finds, American Farmstand Association, their maps, directories, social media, events, and related services.

You represent that you have the necessary rights and permissions to submit the User Content and grant this license.

 

Permission to Use Farmstand Content and Images

By submitting a farmstand for inclusion on Local Farmstand Finds, maintaining a listing on the Local Farmstand Finds map, or becoming a member of the American Farmstand Association, the farmstand, business, member, or authorized representative grants Local Farmstand Finds and American Farmstand Association LLC permission to use certain publicly available business-related content for informational, editorial, educational, and promotional purposes related to Local Farmstand Finds, American Farmstand Association, their programs, events, and services.

This permission includes business-related photographs, logos, product images, farmstand images, business descriptions, and similar promotional content that:

  • is submitted directly to Local Farmstand Finds or American Farmstand Association;
  • appears on the business's public website; or
  • is publicly posted by the business on its official social media accounts.


AFA and LFF may reproduce, display, crop, resize, format, incorporate into graphics, and otherwise use such content for purposes including:

  • Local Farmstand Finds map and directory listings;
  • farmstand features and spotlights;
  • social media posts;
  • newsletters;
  • website content;
  • farmstand crawl and trail promotions;
  • American Farmstand Day promotions;
  • event graphics and materials;
  • educational and informational content;
  • membership promotion;
  • tourism and community partnerships; and
  • other reasonable promotion of the farmstand, Local Farmstand Finds, American Farmstand Association, or their programs.


This permission is non-exclusive and royalty-free.


AFA and LFF will not knowingly use business content in a manner that falsely represents the business or materially alters the meaning of the original content.


The farmstand or member represents that content submitted directly to AFA or LFF, or content published through the business's official website or social media accounts and made available for business promotion, is content the business owns or otherwise has the right to use and authorize for these purposes.


If a photograph or other content is owned by a third-party photographer, designer, customer, influencer, publication, or other rights holder rather than the farmstand or business, the business should not submit or identify that content for use unless it has the authority to permit its use.


Farmstands and members may contact AFA or LFF to request that a particular photograph or piece of content no longer be used in future promotional materials. Such requests will not require AFA or LFF to recall, destroy, or modify materials that were previously published, distributed, printed, or produced while permission was in effect, except where required by applicable law.


17. Listing Corrections and Removal Requests

We encourage farmstand owners and operators to contact us regarding inaccurate listing information.


Local Farmstand Finds reserves discretion regarding the inclusion, presentation, categorization, modification, correction, or removal of listings, subject to applicable law and contractual obligations.


Submitting information does not guarantee that a listing will be published or maintained.


18. Acceptable Use

You agree not to:

  • interfere with the operation or security of the Services;
  • introduce viruses, malware, malicious code, or harmful technology;
  • attempt unauthorized access to accounts, servers, databases, or systems;
  • probe or test vulnerabilities without written authorization;
  • impersonate another person or organization;
  • submit knowingly false or misleading information;
  • use the Services for unlawful, fraudulent, abusive, or deceptive purposes;
  • harass businesses or individuals appearing on the Services;
  • use the Services to send spam or unsolicited mass communications;
  • remove copyright, trademark, attribution, or proprietary notices;
  • frame or mirror substantial portions of the Services;
  • use Local Farmstand Finds trademarks or branding in a manner suggesting an unauthorized affiliation;
  • interfere with another person's use of the Services; or
  • facilitate violations of these Terms.


19. Memberships and Paid Services

Certain features may require payment, membership, sponsorship, advertising fees, event fees, or other charges.


Prices, features, eligibility requirements, renewal terms, and benefits may be described separately at the time of purchase.


Unless otherwise stated, fees are non-refundable except where required by law.


We may modify membership benefits, pricing, or available features prospectively.


20. Third-Party Websites and Services

The Services may contain links to third-party websites, maps, social media pages, payment services, booking platforms, tourism organizations, or other resources.

These third parties operate independently from Local Farmstand Finds.

We do not control and are not responsible for their content, security, privacy practices, availability, products, services, or policies.

Accessing third-party resources is at your own discretion and risk.


21. Intellectual Property Complaints

Local Farmstand Finds respects intellectual property rights.

If you believe content appearing through the Services infringes your copyright, trademark, or other intellectual property rights, please contact us with sufficient information to identify the material and explain your claim.


Where applicable, copyright complaints may be handled in accordance with the Digital Millennium Copyright Act and other applicable law.


22. Trademarks

Local Farmstand Finds, American Farmstand Association, associated logos, branding, slogans, program names, event names, and related marks may constitute trademarks or other protected identifiers.


Nothing in these Terms grants permission to use these marks without prior written authorization.


You may not use our branding in a way that falsely suggests sponsorship, affiliation, endorsement, certification, or approval.


23. Privacy

Your use of the Services is also subject to our Privacy Policy.

The Privacy Policy describes how information may be collected, used, stored, and disclosed.


24. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”


LOCAL FARMSTAND FINDS AND AMERICAN FARMSTAND ASSOCIATION LLC DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.


WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.


WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, SAFETY, QUALITY, LEGALITY, OR CURRENT STATUS OF ANY LISTING, BUSINESS, PRODUCT, LOCATION, EVENT, OR INFORMATION AVAILABLE THROUGH THE SERVICES.


25. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LOCAL FARMSTAND FINDS, AMERICAN FARMSTAND ASSOCIATION LLC, AND THEIR OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, VOLUNTEERS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SERVICES.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM:

  • USE OR INABILITY TO USE THE SERVICES;
  • RELIANCE ON LISTING INFORMATION;
  • TRAVEL TO A LISTED LOCATION;
  • PURCHASE OR CONSUMPTION OF PRODUCTS;
  • INTERACTIONS WITH LISTED BUSINESSES;
  • PARTICIPATION IN EVENTS;
  • LOSS OF DATA;
  • BUSINESS INTERRUPTION; OR
  • THIRD-PARTY CONDUCT.


TO THE EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO LOCAL FARMSTAND FINDS DURING THE TWELVE MONTHS PRECEDING THE CLAIM OR $100.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.


26. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Local Farmstand Finds, American Farmstand Association LLC, and their owners, officers, members, employees, contractors, representatives, affiliates, and agents from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or relating to:

  • your violation of these Terms;
  • your misuse of the Services;
  • your User Content;
  • your infringement of another person's rights;
  • your violation of applicable law; or
  • your unauthorized collection, extraction, use, or redistribution of Local Farmstand Finds data.


27. Suspension and Termination

We may suspend, restrict, block, or terminate your access to some or all of the Services if we reasonably believe you have violated these Terms, threatened the security or operation of the Services, infringed our rights or the rights of others, or engaged in conduct harmful to Local Farmstand Finds, American Farmstand Association, participating businesses, or users.

Provisions that by their nature should survive termination will survive, including provisions concerning intellectual property, data restrictions, disclaimers, limitation of liability, indemnification, dispute resolution, and enforcement.


28. Governing Law

These Terms and disputes arising from or relating to the Services will be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where federal law applies or applicable law requires otherwise.


29. Dispute Resolution and Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY.

To the extent permitted by applicable law, disputes arising from or relating to these Terms or the Services that cannot be resolved informally will be resolved through binding arbitration on an individual basis rather than through a jury trial.

Before initiating arbitration, the complaining party must provide written notice describing the dispute and allow the other party at least thirty (30) days to attempt to resolve it informally.

Nothing in this section prevents Local Farmstand Finds or American Farmstand Association LLC from seeking temporary, preliminary, or permanent injunctive or equitable relief from a court of competent jurisdiction to prevent or stop unauthorized scraping, data extraction, intellectual property infringement, misuse of confidential information, circumvention of technological measures, or other conduct that threatens immediate or irreparable harm.


30. Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.


31. Changes to the Services

We may modify, suspend, discontinue, remove, or introduce features, listings, maps, membership offerings, or other portions of the Services at any time.

We are not obligated to maintain any particular listing, feature, map, event, program, or functionality indefinitely.


32. Changes to These Terms

We may update these Terms periodically.

The “Last Updated” date will indicate when the Terms were most recently revised.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Material changes may be communicated through the Services or other reasonable means.


33. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.


34. No Waiver

Failure by Local Farmstand Finds or American Farmstand Association LLC to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.


35. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.


We may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, transfer of the Services, or other business transaction.


36. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly applicable to particular Services, constitute the agreement between you and Local Farmstand Finds regarding use of the Services and supersede prior agreements concerning that subject matter.


37. Permission to Use Local Farmstand Finds Data

Organizations interested in licensing Local Farmstand Finds data, obtaining API or data access, conducting research, creating partnerships, or using Local Farmstand Finds content beyond ordinary personal use must obtain prior written permission.


Permission may be subject to a separate licensing agreement and applicable fees.


Absence of a response to a permission request does not constitute permission.

2. Permission From Farmstands Appearing on the Local Farmstand Finds Map

Farmstands appearing on the Local Farmstand Finds map have provided Local Farmstand Finds and/or American Farmstand Association LLC permission to use the business and farmstand information submitted, supplied, confirmed, or otherwise authorized by the farmstand for inclusion on the map and related Local Farmstand Finds services.


By submitting a farmstand for inclusion, claiming or confirming a listing, completing a Local Farmstand Finds or American Farmstand Association submission form, becoming a participating member, participating in an AFA or LFF program, or otherwise authorizing inclusion, the farmstand owner or authorized representative permits AFA and LFF to collect, store, organize, reproduce, publish, display, format, update, and use the submitted or authorized business information for purposes including:

  • inclusion on the Local Farmstand Finds interactive map;
  • Local Farmstand Finds directories;
  • regional and local farmstand trails;
  • farmstand crawl maps and materials;
  • American Farmstand Association directories and resources;
  • promotional materials related to Local Farmstand Finds or AFA;
  • social media features and farmstand spotlights;
  • newsletters and communications;
  • event promotion;
  • tourism and community-development partnerships;
  • public education regarding local farmstands; and
  • operation and promotion of the Local Farmstand Finds and American Farmstand Association missions and services.


This permission applies to information the farmstand has provided or authorized for public use and does not grant Local Farmstand Finds permission to publish information that was clearly provided to us as confidential or for internal administrative purposes only.

Farmstand owners may contact us to request reasonable corrections or updates to their information.


3. Public Nature of Map Information

Farmstand information displayed on the Local Farmstand Finds map or directory is intended to be publicly accessible so consumers can discover and visit participating farmstands.

Accordingly, information displayed publicly on a listing may be visible to anyone accessing the Services.


Farmstand owners should not submit personal information for public display that they do not want publicly available.


For home-based farmstands, cottage food businesses, honor stands, or other businesses operating from residential property, submission of an address or precise location for inclusion on the map constitutes authorization for Local Farmstand Finds to publicly display that location unless alternative arrangements have been made with us.


4. Information Collected Automatically

When you visit our website or use the Services, certain information may be collected automatically through website technologies and service providers.

Permission provided by farmstands to AFA and LFF is permission for AFA and LFF to use the information for authorized Local Farmstand Finds and American Farmstand Association purposes.


It does not constitute permission for unrelated third parties to collect the Local Farmstand Finds database or use the information in violation of our Terms of Use.


Automated scraping, bulk extraction, systematic harvesting, creation of competing or derivative databases, commercial data mining, unauthorized lead generation, and artificial intelligence or machine-learning ingestion of Local Farmstand Finds content are prohibited as described in our Terms of Use.


12. Artificial Intelligence and Data Mining

Local Farmstand Finds does not grant third parties permission to use personal information, farmstand listing data, map data, directory data, photographs, descriptions, or other Local Farmstand Finds content for training, fine-tuning, grounding, testing, or developing artificial intelligence or machine-learning systems unless expressly authorized by us in writing.

Public availability of information through our website does not constitute consent for such use.

Farmstands and AFA members may submit photographs, logos, descriptions, product images, and other promotional materials to Local Farmstand Finds or American Farmstand Association.

Farmstands appearing on the Local Farmstand Finds map and members of the American Farmstand Association also authorize AFA and LFF to use certain business-related photographs, logos, descriptions, and other promotional content made publicly available through the business's official website or social media accounts for informational, educational, editorial, and promotional purposes related to AFA, LFF, participating farmstands, events, trails, crawls, programs, and community initiatives.


Such content may be used on the Local Farmstand Finds website and map, American Farmstand Association website, social media, newsletters, farmstand features, event promotions, graphics, printed materials, and other AFA or LFF communications.


Additional terms governing this permission and the use of business content are provided in our Terms of Use and applicable membership or listing terms.


22. Aggregated and De-Identified Information

We may create aggregated or de-identified information that does not reasonably identify an individual.


We may use and disclose aggregated or de-identified information for purposes such as:

  • research;
  • tourism reporting;
  • economic-impact analysis;
  • sponsor reporting;
  • program evaluation;
  • community outreach;
  • marketing;
  • grant applications;
  • event planning; and
  • improving Local Farmstand Finds and AFA programs.


We may retain this information as permitted by applicable law.


23. Changes to Farmstand Listings

Farmstand owners and authorized representatives may contact us regarding corrections to their listings.


We may verify the identity or authority of the requester before making significant changes to a listing.


Removal of a listing from public display does not necessarily require deletion of all internal records associated with that listing where retention is reasonably necessary for legal, recordkeeping, fraud-prevention, or administrative purposes.


24. Business Information Versus Personal Information

Some information collected by Local Farmstand Finds relates to businesses rather than individuals.


Business names, public business addresses, public business telephone numbers, public websites, public social media profiles, and similar business information may not be treated as personal information under every privacy law.
